This Commercial License (“License”) governs your rights to use images and related assets generated through Mock It AI (the “Outputs”). It incorporates and is subject to the Terms & Conditions, Acceptable Use Policy, Refund Policy, Cookie Policy, and Privacy Policy (collectively, the “Agreement”). Capitalized terms not defined here have the meaning in the Agreement.

1) Key definitions

  • Outputs: Images and mockups generated by or through the Service for your account, including upscales/variations, excluding any third-party content you upload.
  • User Content: Materials you upload (e.g., logos, artwork, prompts, product photos). You retain ownership of your User Content.
  • Derivative Works: New works you create using Outputs (e.g., composites, ads, website graphics, product listings).

2) Ownership

  • Outputs are owned by Mock It AI. No ownership in Outputs is transferred to you.
  • You retain ownership of User Content you upload. You grant Mock It AI the operational licenses described in the Terms to run the Service.

3) Grant of license

Subject to the Agreement and timely payment of fees, Mock It AI grants you a non-exclusive, worldwide, non-transferable, non-sublicensable, perpetual license to use, reproduce, display, perform, modify, and create Derivative Works from Outputs for commercial purposes.

3.1 Permitted business uses (examples)

  • Websites, landing pages, blogs, social media, emails, ads, presentations.
  • Product pages, catalogues, lookbooks, investor decks.
  • Client deliverables in the ordinary course of services you provide to a client.
  • Print uses (e.g., posters, packaging, in-store displays).
  • Using the image as part of a pitch/portfolio to sell real products that the mockup depicts.

4) Restrictions (what you may not do)

You may not:

  1. Resell, redistribute, or license the Outputs “as-is” (e.g., stock assets, template packs, mockup libraries, NFTs of the raw Output).
  2. Offer Outputs as a service or database enabling others to download/use them as stand-alone assets (including via APIs or asset bundles).
  3. Use Outputs, prompts, metadata, or any artifacts to train, fine-tune, or improve any AI models or datasets (your own or a third party’s).
  4. Claim human authorship or exclusive IP in the Outputs themselves (you may claim authorship of your Derivative Works only).
  5. Infringe third-party rights (copyrights, trademarks, publicity, moral rights) or violate the AUP (e.g., nudity/sexual content, children, hate, explicit violence, doxxing, malware, political persuasion, deepfakes of real people, illegal activity).
  6. Register Outputs (or trivially modified versions) as a trademark, design mark, or similar exclusive right.
  7. Remove or obscure notices embedded by Mock It AI, if any.

Template/overlay assets that Mock It AI provides (e.g., garment shapes, displacement maps) are covered by this same license: commercial use is permitted within your projects, but stand-alone redistribution or template resale is prohibited.

5) Seats & account scope

  • This license attaches to one natural person (one seat) per subscription. You may not share logins or pool credits across different individuals without a plan that permits it.
  • Agencies/teams require additional seats or an enterprise plan permitting multi-user access.

6) Clients & subcontractors

  • You may deliver Derivative Works to your clients as part of your services. Your client may use such deliverables for their own business purposes, but you may not grant them any rights to redistribute the underlying Outputs as stock/templates or to use them for model training.
  • Subcontractors may handle files solely on your behalf under your direction and must follow this License; you remain responsible.

7) Duration; termination

  • The license to any Outputs generated while your account was in good standing is perpetual, subject to the Restrictions and Section 10 (Termination for cause).
  • If your account is suspended/terminated for breach (e.g., AUP violations, fraud, non-payment after retries), we may revoke this License for affected Outputs. We may allow a cure period at our discretion.

8) Third-party rights & clearances

  • You are solely responsible for ensuring you hold all rights to User Content (e.g., logos/marks you upload) and for the legality of your prompts/uses in all regions where you operate.
  • Mock It AI does not guarantee that any Output will be free of third-party rights or suitable for trademark/copyright registration or exclusive use. Conduct your own legal review for high-stakes campaigns.

9) No training on user outputs

Mock It AI does not use your User Content or Outputs to train its models.

10) Revocation for breach

We may suspend or revoke this License (in whole or part) immediately if you materially breach the Agreement or this License (e.g., prohibited content, resale as stock/templates, model-training use, account sharing), without obligation to refund fees. We may seek further remedies available at law.

11) Attribution

No attribution is required. If you choose to credit, use “Image generated with Mock It AI.”

12) Warranties; disclaimers

The Service and Outputs are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including non-infringement, merchantability, fitness for a particular purpose, accuracy, or uniqueness. AI outputs may be non-unique, contain artifacts, or require human review.

13) Limitation of liability

To the maximum extent permitted by law, Mock It AI’s aggregate liability under this License will not exceed the fees you paid in the 3 months preceding the event giving rise to liability. We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits or business interruption.

14) Indemnity

You will indemnify and hold harmless Mock It AI and its affiliates from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your User Content or prompts; (b) your use of Outputs or Derivative Works; (c) your breach of this License or the Agreement; or (d) your violation of laws or third-party rights.

15) Audit & enforcement

We may request reasonable information to verify compliance (e.g., seat usage, distribution methods). Failure to cooperate may result in suspension or termination.

16) Updates

We may update this License. Material changes will be notified by email or in-product notice at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.

17) Order of precedence

If there is a conflict between this License and the Terms, the more restrictive provision controlling Outputs and redistribution prevails. Otherwise, the Terms govern.
