1. Agreement to Terms
By accessing or using Mock It AI’s websites, subdomains, and services (the “Service”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Service.
2. Eligibility
You represent that you are capable of entering a binding contract and will use the Service only in compliance with applicable laws. Users located in jurisdictions that restrict child data (e.g., the U.S.) must be at least 13. If local law requires a higher age of consent, you must meet that age.
3. The Service
Mock It AI provides an AI photoshoot/mockup generation platform with a prompt builder that produces images and editable mockups (the “Outputs”). Future features may include a community gallery with admin approval (“Community”). Accounts function across our main domain and app subdomain (SSO).
We may modify, suspend, or discontinue features at any time. No formal uptime commitment is provided.
4. Accounts & Security
You must maintain accurate account details and safeguard your credentials. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
5. Plans, Billing & Credits
Plans: Starter (100 credits), Growth (250 credits), Pro (650 credits).
Billing: Monthly recurring via Stripe. Proration applies on plan changes; you may upgrade/downgrade at any time.
Credits: 1 credit is consumed per image/mockup generation. Credits expire at the end of each billing period (no rollover). Credit packs (top-ups) may be offered in future.
Renewals & Payment Retries: We may attempt up to 8 payment retries over 14 days for past-due invoices. If unsuccessful, your subscription will auto-cancel.
Taxes: Prices currently exclude taxes; no tax is collected. If this changes, we’ll notify you.
Abuse: Any suspected abuse, fraud, or circumvention of limits may result in immediate suspension or termination without refund.
6. Cancellations, Refunds & Chargebacks
Cancellations: You may cancel anytime; your subscription remains active until the end of the current billing period.
Refunds: No money-back guarantees. Refunds are issued only for reproducible technical issues that we cannot resolve or otherwise at our discretion. No partial refunds.
Chargebacks: Initiating a chargeback may lead to account suspension. We reserve the right to contest chargebacks.
7. Acceptable Use
You may not use the Service to create, upload, or distribute content that is illegal or harmful, including (without limitation): nudity/sexual content, content involving children, hate speech/symbols, explicit violence, self-harm, illegal drugs, weapons, doxxing, malware, IP infringement, deepfakes of real people, political persuasion/targeting, or any other content we reasonably deem abusive or risky.
You may not: scrape, reverse engineer, attempt to extract models, benchmark for public disclosure without consent, bypass technical limits, or interfere with the Service.
A more detailed Acceptable Use Policy forms part of these Terms and will govern specifics.
8. User Content; License to Us
User Content includes materials you upload or provide (e.g., prompts, artwork, logos). You retain ownership of your User Content. You grant Mock It AI a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display your User Content solely to operate, secure, and improve the Service and to comply with law.
Community (future feature)
- By default, accounts will be opted-in to allow their approved Outputs to appear in the Community.
- Publication is not automatic: all items are reviewed for approval.
- You will be able to opt-out at any time in your profile (feature coming soon).
- We may showcase approved items on our sites/socials/marketing. If you later opt out, we’ll cease new uses within a reasonable time; previously printed/posted materials may persist.
9. Outputs; Ownership & License
Ownership: Mock It AI retains ownership of all Outputs and underlying models/assets.
Your License: Subject to these Terms and your ongoing compliance (including payment), Mock It AI grants you a non-exclusive, worldwide, non-transferable, non-sublicensable commercial license to use, reproduce, display, and create derivative works from Outputs for your business (websites, social media, ads, email, merchandising mockups, client work, etc.).
Restrictions: You may not:
- resell, redistribute, or license Outputs as stock, templates, or in any “as-is” asset library;
- use Outputs, prompts, or artifacts to train or fine-tune any AI models or datasets;
- claim Outputs are wholly “human-authored”;
- remove proprietary notices or attempt to assert exclusive IP in Outputs beyond this license.
Additional terms may appear in a separate Commercial License (which will prevail in case of conflict).
10. Third-Party Rights & Brand Use
You are solely responsible for ensuring you have rights to any uploaded artwork, logos, or third-party materials. Certain brands, marks, or likenesses may be prohibited (e.g., well-known luxury or entertainment brands) and may trigger moderation/denial. We do not provide clearance or legal advice regarding third-party rights.
11. No Model Training on Your Content
Mock It AI does not use your User Content or Outputs to train its models.
12. Communications
By creating an account, you agree to receive transactional and service emails. Marketing emails may also be sent; you can opt-out via unsubscribe links at any time.
13. Privacy
Our Privacy Policy explains what data we collect (e.g., name, email, IP), how we use it, and your choices. By using the Service, you consent to those practices.
14. Pricing & Changes to Terms
We may change prices and material terms with 7 days’ email notice. Continued use after the effective date constitutes acceptance. If you disagree with changes, you must stop using the Service before they take effect and cancel your subscription.
15. Suspension & Termination
We may suspend or terminate access immediately for violations of these Terms, legal risk, non-payment, or to protect the Service or users. Upon termination, your license to Outputs survives only to the extent already granted and paid for; any unpaid amounts remain due.
16. Disclaimers
AI limitations. Outputs may be inaccurate, non-unique, or unsuitable for a particular purpose and may require human review. The Service is provided “as is” and “as available” without warranties of any kind (including fitness for a particular purpose, merchantability, non-infringement, or accuracy).
17. Limitation of Liability
To the maximum extent permitted by law, Mock It AI and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenues, data, or goodwill; or business interruption. Our aggregate liability for any claim relating to the Service will not exceed the amounts you paid to us in the 3 months preceding the event giving rise to liability.
18. Indemnity
You will indemnify and hold harmless Mock It AI from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your User Content; (b) your use of Outputs; (c) your breach of these Terms; or (d) your violation of laws or third-party rights.
19. IP Complaints
If you believe content infringes your rights, contact support@mockit.ai with details (rights asserted, location of the material, your contact info, and a good-faith statement). We may remove content, request more information, or take other appropriate steps.
20. Export & Sanctions
You must comply with all applicable export control and sanctions laws and may not use the Service in embargoed or sanctioned jurisdictions or for prohibited end uses.
21. Miscellaneous
- Entire Agreement. These Terms, the Privacy Policy, Acceptable Use Policy, Cookie Policy, Refund Policy, and any applicable Commercial License form the entire agreement.
- Severability. If any provision is unenforceable, the remainder remains in effect.
- Assignment. You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a merger, acquisition, or asset sale.
- No waiver. Our failure to enforce a term is not a waiver.
- Notices. We may notify you by email or via the Service.
